At the end of February, the Croatian Law Centre submitted comments to the Croatian Parliament on the Proposal for Amendments to the Law on International and Temporary Protection, which has been sent to parliamentary procedure for further alignment with the legal framework of the European Union, particularly the Pact on Migration and Asylum.

The Croatian Law Centre warns that certain parts of the proposed legislation require additional normative clarification and refinement to ensure full compliance with the new European framework and to prevent potential legal ambiguities in the implementation of the Law on International and Temporary Protection.

The key concerns relate to the insufficiently clear approach to the application of regulations stemming from the Pact on Migration and Asylum, inadequate alignment with minimum standards regarding the detention of applicants for international protection, and insufficiently developed safeguards for unaccompanied children. The comments also highlight limitations affecting the effectiveness of legal aid in proceedings before the Ministry of the Interior of the Republic of Croatia, the inadequate transposition of the right to healthcare and rehabilitation, and the introduction of an additional requirement for family reunification through passing an exam in the Croatian language.
